Terms & Conditions

The following terms and conditions are issued by Pavetech Laboratory Limited (“we” / “us” / “our”). By placing payment to this invoice, you accept these terms and conditions. We reserve the right to change these terms and conditions at any time and without notice. It is your responsibility to regularly check these terms and conditions for any changes.

1. General Information

You agree all testing ordered by you are acquired by you for business purposes and accordingly that the Consumer Guarantees Act 1993 does not apply.

During the test request process, you must undertake that all details you provide to us for the purpose of purchasing testing or services are correct.

We reserve the right to terminate our contract with you if:

• You fail to make payment to us when due

• You breach any of our terms and conditions

• When requested by us to do so, you fail to provide within a reasonable time frame, enough information to let us check the accuracy and validity of any information supplied by you, or your identity. 

2. Liability

Instead of any condition or liability implied by law, should any testing carried out be found to be defective or in our error, a non-conformance will be issued and material retested if possible at our expense. To the extent permitted by law, these are your sole remedies in relation to any defective testing or any default by us under these terms and conditions, and in no circumstances will our liability to you exceed the price of the testing, nor do we accept any liability for any direct loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the supply of any testing by us.

You must ensure that testing ordered is correct and suitable for the purpose for which they are required – we will help you order the correct testing but we are under no liability if they are not. If plans, specifications and/or requirements have been given to you, it is your responsibility to ensure that the testing supplied by us will be satisfactory to meet such plans, specifications and/or requirements. 

3. Law

These terms and conditions are to be construed in accordance with the laws of New Zealand and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the New Zealand courts.

4. Entire Agreement

The terms and conditions above constitute the entire agreement between us and supersede any and all preceding and contemporaneous agreements.
